What is Delta 8

Delta 8 is one of hundreds of naturally occurring cannabinoids found in the cannabis plant. It is not present in large quantities. The Delta 8 sold by reputable manufacturers is extracted from CBD. Legal CBD and Delta 8 products are extracted from USA grown industrial hemp.

Delta 8 versus CBD

On May 22nd, 2022, the Ninth District Court ruled that products containing hemp derived Delta 8 is legal under the 2018 Omnibus Farm Bill. The decision also codified that Delta 8 is entitled to trademark, copyright and other legal protections.

While Delta 8 is legal on a federal level, a number of states have moved to ban it. Delta 8 is currently barred for sale in 13 states. Politically, it is a mixed bag that includes Alaska, Colorado, Delaware, Idaho, Iowa, Montana, New York, Nevada, North Dakota, Rhode Island, Vermont, Utah, and Washington. 

Six of the states that have banned Delta 8 allow recreational use of cannabis, ten allow medical use and three have decriminalized recreational use. This is a unique turn of events that may owe much to the fact dispensaries have lobbied for years and pay a great deal for a monopoly to sell cannabis products. Legal hemp derived products could very well be perceived as competition.  

Defending commercial interests and making common cause with cannabis prohibitionists to deny adults access to federally legal products is a short-sighted gambit.

Critics of Delta 8 complain about a lack of research. This issue was addressed in a joint research project conducted by the University of Buffalo and University of Michigan.

The dual survey of more than 500 participants focused on comparisons between traditional Delta 9 THC (cannabis) and Delta 8. The study’s authors concluded that Delta 8 THC is Delta 9’s “nicer younger sibling” because it similar effects but with fewer adverse reactions.

 

Results of Delta 8 Study

Published in the Journal of Cannabis Research, the study was co-authored by Jessica Kruger. She is a PhD, a clinical assistant professor of community health and health behavior at the University of Buffalo’s School of Public Health and Health Professions.

Jessica Kruger came to the following conclusions concerning Delta 8: 

“Because this is one of the first studies of its kind on delta-8-THC and so many states have changed their legislation, we wanted to really explore what people felt as they were using it compared to delta-9-THC. We found that people who are utilizing delta-8-THC feel fewer negative side effects, and they are using it in modalities that are safer, like vaping or edibles or using topically.”

Study co-author Daniel J. Krueger from the University of Michigan raised questions about bans on Delta 8 during the decriminalization of its more potent cannabinoid relative THC. 

“It’s paradoxical that different states and municipalities are opening up to delta-9, it’s becoming more available and increasingly legalized, and yet they’re putting the brakes on delta-8, even though it seems to have a better profile in terms of its effects. It’s almost like the opposite of what you would do if you were informed of the evidence."
