The vape industry could use some good news right now—such as the postponement of the USPS vape mail ban. The final rule was supposed to be submitted to the Federal Register on or before April 27. As of this writing, USPS has failed to publish their final rule.

Vape shops (and consumers) might be able to use USPS until the final rule is published. The PACT Act has created many other challenges for businesses in the vaping industry, some of these challenges may still impact the shipping ability for a business or consumer.
But what does this mean for the USPS? The USPS, despite being one of the most trusted federal agencies, has also been unprofitable for over a decade (and possibly longer)—could there possibly be a financial incentive involved? Under current Postmaster General Louis DeJoy, there have been proposals to cut local two-day delivery and a $9.2 billion loss due to the COVID-19 pandemic in 2020. USPS is also $200 billion in debt, compounded by years and years of operating at a loss.
From the perspective of the vaping industry, figuring out a USPS shipping solution could benefit the vaping industry and USPS’ bottom line. DeJoy’s approach to leading USPS has involved actions consistent with decisions businesses in many industries would take when one is operating at a loss, such as cost-cutting. A creative solution that could allow vape mail to continue in some format, may reduce USPS’ debt and slow potential future losses.
Why The Delay Could Create More Uncertainty
The delay could also create more uncertainty—nobody knows exactly when USPS’ final rule will be published. “Despite our best efforts, in order to ensure thorough and thoughtful consideration of the complex issues and voluminous comments by industry, individual, and governmental stakeholders, the Postal Service is unable to publish a final rule by today’s target date,” said David P. Coleman, a spokesperson for the USPS.
